These Terms of Service ("Terms") govern your access to and use of the Now On Me browser extension, the website at nowonme.com, and related services (together, the "Service"), operated by Now On Me ("we", "us"). By installing, signing up for, or using the Service — including any free tier — you agree to these Terms and to our Acceptable Use Policy and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract. The Service is not directed to children. You are responsible for keeping your account credentials secure.
The Service uses artificial-intelligence models to generate a visualisation of you wearing or using a product, based on a photograph you supply and a product image from a page you visit. Outputs are AI-generated approximations — they are not photographs, may be inaccurate, and must not be presented as real, endorsed, or as an actual depiction of any product, fit, or person.
You may only upload photographs that you own or have the explicit, documented consent of every identifiable person in them to use for this purpose. You are solely responsible for your photos and for obtaining any necessary permissions. You must not upload images of any other person without their consent, images of minors, or images you are not lawfully entitled to use.
You retain ownership of your photos and of the outputs generated for you. You grant us a limited, worldwide, royalty-free licence to host, process, and transmit your photos and product images solely to operate and provide the Service to you (including sending them to our AI sub-processors), and to store outputs and metadata as described in the Privacy Policy. We do not claim ownership of your content and do not use your photos to train models without your separate, explicit consent.
Your use is subject to the Acceptable Use Policy. In summary, you must not use the Service to create or attempt to create nudity or sexual content, content depicting minors, non-consensual or deceptive imagery (including deepfakes of real people without consent), or any illegal, infringing, harassing, or harmful content. Violations may result in immediate suspension or termination, including automated blocking (see §7).
The Service relies on third-party AI providers (currently Google's Gemini API and fal). Your use of the Service is also subject to those providers' terms and prohibited-use policies, including Google's Generative AI Prohibited Use Policy. You must not use the Service in any way that would violate a provider's policies. We may change providers at any time.
THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that outputs are accurate, realistic, or suitable for any purpose, or that the Service will be uninterrupted or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) £100. Nothing in these Terms limits liability that cannot be limited by law (e.g. for death or personal injury caused by negligence, or fraud).
You agree to defend, indemnify, and hold harmless Now On Me and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your photos, product images, or generated content; (b) your use or misuse of the Service; (c) your violation of these Terms, the Acceptable Use Policy, applicable law, or the rights of any third party (including image, privacy, publicity, or intellectual-property rights); or (d) any lack of the consents or rights you represented you held under §4.
We may update these Terms. Material changes will be notified in-product or by email where appropriate. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
